State Farm uses CCC Value One and they have “one value” and it is low! When you have a total loss claim with State Farm Insurance you will receive a settlement letter which states the ACV or actual cash value of your car plus the various taxes, fees and deductible. If you talk to them on the phone they will quote these numbers but they may not explain exactly how they came up with them.

  What they do not make clear is that State Farm Insurance does not employ anyone whose job it is to follow the market and keep track of what any particular car is worth on a given day. Instead they rely on CCC Intelligent Solutions in Buffalo Grove IL to provide them with a “valuation” for each totaled vehicle on which a claim is filed. State Farm is by no means the only insurance company using CCC, almost all of the major insurance companies use them. We might think that CCC Value One is a product of the Internet age but in reality they have been around for decades. Interestingly they do not claim to be auto appraisers, in the fine print in the upper right hand corner of the first page it states that the accompanying report represents CCC’s “opinion” as to the value of the car in question. I think that gives them some cover in the myriad of class actions they find themselves defending.

  Now that you have your total loss settlement offer you may discover that it seems to be low. Be sure and get State Farm to send you the CCC report. You do not want to settle an insurance claim on a phone call or even off of the settlement letter. You want to know exactly how they came up with the price they are offering you for your car and the only way to determine that is to see the CCC Value One. If you sign in to the State Farm app online and look in “my documents” or “my claims” you will be able to find it.

  When you do get the CCC document check the information on it. You may find they have your car improperly classified. They may have it as an EX Honda when in reality it is an EX-L. You also need to pay attention to their notes on the condition of your vehicle. Oftentimes they will have derogatory information listed that simply is not factual.

  You also should look at the comps that they use In determining the value of your car. A lot of the time we find that these are way off the mark. You may have a diesel Crew Cab truck and they will use comps that are regular cab and gas. Don’t spend too much time worrying about this part because if you wind up invoking your right of appraisal all of the information on the CCC document is out the window. The appraisal company that State Farm hires is not there to defend the CCC, they will develop their own appraisal.

  The last thing to know about the CCC Value One report is this, the “adjustments”. The adjustments is where they get us. They will use all sorts of vehicles for comps and then make “adjustments” for the difference in miles and equipment to your car. You will note that all the adjustments are “down” when it comes to the effect they have on the value of your car. I have had clients that were stockbrokers and math professors tell me “I prepared a spreadsheet of the CCC data and it doesn’t balance out!”. I tell them “Bernie Madoff’s figures didn’t balance either. Maybe it’s a scam?

  The next step is to look at the book values, KBB, NADA and Edmunds to see what sort of valuation they have for your car. Sometimes they are accurate and sometimes not so much.

  Lastly and most important look for comps. This means shop to replace the car you had not shop for the car you are going to buy. What I mean is if your car had 120,000 miles you need to look for comps with at least 95,000 miles, not cars with 50,000 and then make some sort of adjustment. They do that, we don’t. The insurance company will tell you you can only look within a certain radius of your address. State Farm may tell you 150 miles. This goes back to the days when we all bought cars out of the newspaper and that was about as far away of a newspaper as you are likely to get. The local market for a lot of cars today is the Internet. If you have a car that is somewhat rare you may not find any examples inside of 150 miles. Not only that but even if you are shopping for a Toyota Camry you might travel some distance to get exactly the one you want.

  OK so you have done all of the above and determined that the offer they are making you is $3000 less than it should be, now what? It would seem that if you got your book values and your comps together and called the adjuster you might be able to negotiate a better offer. Very often the answer is no and here is why.

  They are under no obligation to negotiate with you. They are in the business of collecting monthly premiums on your car insurance, not paying claims. Not only that but the person at State Farm that you are dealing with almost never is someone with actual authority to raise the offer. All they can do is call CCC One. And when they do that the people in Buffalo Grove IL have absolutely no motivation to give you any more money for your car. Their contract with State Farm is based on them minimizing the payout on every claim thusly maximizing the return to the shareholders. I am not saying that no one ever succeeds in getting a substantial raise in the payout without going to the right of appraisal but I will say it is extremely rare.

  This brings us to the appraisal clause in your policy. You have the right of appraisal. That means you can hire an independent auto appraiser and State Farm will do the same. At this point in time the appraisal companies that they are using are highly qualified and fair. Essentially you get us, we write you an appraisal and send it to you, you send it to State Farm and they will forward it to one of their outside appraisers. Those people will contact us and negotiate a settlement of your claim. We won’t take your case unless we can guarantee to get you a minimum of $1000 more for your car. We charge $250 or 10% of the improvement whichever is more and we do not charge any money up front.
