 So you have received the “offer”(total loss car insurance settlement) from CCC Value One or JD Power Mitchell or whichever and it is low. No surprise, that is their job. The insurance companies pay them to generate these bogus “valuations” to shortchange the claimant by $1,000/$2,000 +++ per car.

  It seems like if you put together a presentation of the book values and some classified ads for cars similar to yours, that you could negotiate a reasonable settlement with the insurance company? 

Most often not, and here’s why.

  They are under no obligation to accommodate you, they are in the business of collecting premiums, not paying claims. They may “come up” a few hundred bucks or more likely, they may start with the pressure tactics saying “you better take this amount, it may go down, that’s ALL we will EVER pay for this car, give us the rental back” etc. Not so!

   So your car’s been in an accident and they determined it’s a total loss and now you have the offer from the insurance company and it seems awfully low. Most of the time it IS significantly less than the car should be worth. The first thing most people do is go online and look at the “book” values KBB, NADA etc. Having done that, now you are wondering “how did they come up with the number they are using as my car’s value”? (“totaled car value calculator” is widely searched)

  Here is the issue, the outfits (like CCC Value One) that provide these totaled car valuation services (they are not appraisers and don’t claim to be) have a business model as follows: undervalue every car by X amount. The insurance companies subscribe to these “valuation services” at a set fee per file to come up with the lowest possible but somewhat justifiable number. The theory is simple, if they undervalue 1,000 claims by $2,000 each that is $2 million. Out of 1,000 claims how many people are going to make a serious effort to dispute the amount?

How DO they come up with the lowball number? Lots of ways. First they run “comps” that aren’t “comps”. I mean you may have a crew cab truck that’s a diesel and they will mix in a regular cab that’s gas. Or your car may be a “Limited” top of the line model and they use “S” or whatever the base biscuit version of that car is called. If they provide VIN’s on their comps run them thru Google. Do they exist? Are they for sale at the dealership listed? Are they for sale at dealerships that specialize in “framers”, cars with accident histories? And they always use crazy arithmetic to “adjust for miles” but the adjustment is always a deduction from the value of your car. Lastly they will deduct an amount from each comp they have listed for a “take price” meaning the amount the dealer will “come down” on the asking price. 

In order to try and fight this system there are a few things you can do but….you have to realize going in that the whole thing is rigged. It is a scam, period. The adjuster at the insurance company will say “we looked at your total loss claim and analyzed the data blah blah”. They (the adjuster) didn’t do squat, they arranged to get pictures of the car to CCC Value One or Mitchell Valuation or whoever put this package together on your car and those crooks set the number. I should mention here that by the terms of your policy the insurance representative is REQUIRED to advise you that you have the “right of appraisal” as soon as you begin to complain about the amount of the offer. Not only will they not do that, a great many of them will tell you that you CAN’T get an appraisal, “take this amount or walk”!

  OK, you have your book values. Now get some comps. Make sure they are actual comps, you can’t use 60,000 mile units if yours had 120,000. You CAN go “out” a distance. The insurance weasels like to say “you can only look 150 miles away”. Nonsense, that was the deal in the old days when we all bought cars out of the newspaper. Today everybody shops on the internet and if the car or truck you are trying to replace has any rarity at all you may have to go hundreds of miles or more to find one. And this “take price” is B.S. too. Car dealers today all advertise thru” programs” such as V-Auto, True Car, Car Guru’s etc where page placement is dictated by asking price alone. So in order to rank high on the page they have to have the lowest price possible. This results in all kinds of “fees”, doc stamps, additional costs of all sorts being ADDED to the price. You would be a hero of negotiation to get the car bought AT the asking price, you will not be getting a discount.

Got your book values and the comps and your arguments about “take price” and shopping distance? Take another shot at them. They may “discover” a few hundred bucks they can offer after a “re-evaluation” of your claim. You can also throw in that you are going to invoke your right of appraisal. The insurance companies that play by the rules and hire outside appraisers usually pay those people fairly well and don’t want to spend the money plus they know that if you get an appraiser that’s good, (me for instance), they are going to lose. I should mention that at this point they may tell you “you can get an appraisal but the amount might go down”. It can’t, it is called the “undisputed amount”. Or they will tell you “if the appraisers don’t agree it will go to an umpire and you will have to pay for that”. If the appraiser you get, and the appraiser they get, are any good at their job there won’t be any umpire. (I have done the umpire twice in ten years).

Having done all this, and having undergone a bunch of stress dealing with these often very unpleasant people, where have you wound up? I have seen people get them up a few hundred and sometimes a couple thousand BUT the question remains is the figure you are at now the right number?

Chances are that if you are so unfortunate as to have a totaled car, you may very well get a settlement offer written by these CCC Value One crooks out of Chicago. The insurance companies have been using them for decades simply because they “game the system” in favor of the insurance firms. Esurance, Allstate, Geico, State Farm, Safeco Insurance use the CCC auto valuation lowball most of the time.

Usually you will discover they are trying to beat you out of around $2,000 but I have settled lots of claims where we wound up getting $3,000/$4,000++++ more, all the way up to just doubling the offered amount!

Don’t get hung up on the “comps” they use, or the “adjustments” which always seem to be adjusting your payout lower, once you get us involved the CCC vehicle value figure goes out the window (or in the trashcan) where it belongs.

How does the Appraisal Clause work on Total Loss Claims?

Your insurance policy has a provision for you to get an independent appraisal if you are dissatisfied with the amount they offer for your totaled car. This is known as the appraisal clause or appraisal provision. Often the outside contractor they have place a value on your car classifies it incorrectly, such as making an “LE” a base model or your 4WD truck a 2WD. Other times they just start too low, lately I see a great many offers that are auto auction wholesale figures right off of the MMR (Manheim Market Report).

Here is the good news, once you tell them you are going to get an independent appraisal and submit it, the process moves out of the insurance company office and goes to a car appraiser hired by them. Almost always I find these to be “car guys” not “corporate weasels”, and reasonable as to what constitutes “fair market value” for your car. Very often I have dealt with them before and they know Sun Auto Appraisers has the documentation to support my position. 

While some companies resist spending the money for the outside appraiser, I can make them settle with us for the same amount we would be awarded in the appraisal process even if they refuse to “play by the rules”.

USAA Totaled Car Value Calculator | Total Loss Claim USAA

USAA is indeed one of the worst for lowballing people and they have the “20% replacement assistance” offer to prove it!  You pay extra every month and if you car gets totaled they “give” you 20% over the CCC Value One lowball “offer”. That will pretty much put you somewhere near the actual value of the car. If you DO have the 20% bump on your policy, get with me anyway, I can raise the settlement and THEN they have to ad the 20%.

Safeco uses CCC Value One and the one value they will put on your car will be low! You have an “appraisal clause”, the right of appraisal, in your policy. If you we determine that we can help you, they will have to get an independent appraisal company to negotiate with us to settle your claim. Most of the time the appraisal companies the insurance hires are people we deal with all the time which means we can get better results than anyone else.

Esurance Totaled Car Value Calculator

Here is a typical case we settled with Esurance. The client had a 2018 Hyundai Sonata Hybrid that was maintained properly and a nice car. So of course CCC Value One hit it nice and low at $17,304.

Esurance uses a few appraisal companies and I am usually able to work very well with them. In this instance I got $21,500 plus tax and title fees, so an improvement of $4,196!

AAA Insurance Total Loss Claim Success

This lady had a 2009 Cadillac CTS that she bought new at Dimmit Cadillac and kept in the garage. She had AAA Insurance and had a total loss accident at 17,000 miles. The CCC Value One people claimed the actual cash value of the car to be $9,656. Super low miles, garage kept and lots of equipment, (these cars come in a wide range of “content”) and this one was well equipped.

I wrote the appraisal which the client submitted to AAA. At that point they are supposed to hire an independent appraiser and stop talking to the customer but instead they called her and “raised the offer” by $400!! Shady practice to say the least. After a few days I was able to settle the claim today (12/10/18 (this is an updated post) for $13,500 plus tax and title fees. A net gain on the car price of $3,844!

Here is a another AAA “deal” 10/26/20 in Texas – AAA CCC Value One offered this lady $10,262 for a super nice Volvo and jerked her around severely when she protested the amount. Once I got it into the appraisal process I was able to get $13,000, an improvement of $2,738 before tax!

Will my flooded car be totaled?

Hurricane or “100 year downpour” flood car?

The short answer is yes it should be. Modern cars that get any amount of water inside are almost impossible to restore. You may have the adjuster tell you “we can dry it out, the damage is actually $1,000” or some such nonsense but once it gets to the repair shop they can deal directly with the insurer and get that rejected. 

  When these large loss events happen the insurance companies hire a lot of independent adjusters and pay them according to how many claims they can process quickly. That will lead to making mistakes in favor of the insurance company. The experienced adjusters that will make the final decision are well aware that the electronic components in todays cars are pretty much toast if they are exposed to water, especially brackish or salt water as is common in the recent Florida flooding.

  The next issue will be the payout. The insurance company will make you an offer and probably push you to settle right away. Make them put the offer in writing (email) and show you where they got the figure from (CCC Value One, Mitchell Valuation etc). A phone call “sorry about your flood loss totaled car, but I do have your check here, want us to mail it?” is no good.  Does the amount include tax? Can you get the same car in the same condition for that amount?
